The Defendant was accused of running a red light through an intersection while intoxicated. The Defendant's Breathalyzer results were over the legal limit of .08%. As a result, the Defendant was charged with OUI and related charges in the Wareham District Court. Attorney Fahy was able to get all charges DISMISSED.
8/30/23: Assault & Battery with a Dangerous Weapon
Defendant was charged with attacking his neighbors and their friends/guests with a pipe/rod. Attorney Fahy was able to secure a doctor for the client who testified that the time of the events the client did not know right from wrong and was unable to conform his behavior to the rules and norms of society. NOT GUILTY (Defendant found to be not criminally responsible as a result of his mental health illness)
12/11/23: Rape
Defendant was indicted with the rape of an individual known to him. At trial, a
fter several days of testimony by the alleged victim and witnesses who were around the parties prior to/after the alleged events, the Defendant was found NOT GUILTY.
12/18/23: Rape; Incest; Strangulation.
The Defendant was indicted on charged that alleged the raped and strangled a close faily member. Evidence included DNA of the Defendant that was allegedly found on the alleged victim. After the alleged victim, several witnesses from before/after the alleged events and Massachusetts State Police Crime Lab Chemists testified over several days at Trial, the Defendant was found NOT GUILTY.
4/6/22: Larceny Over $1,200. Attorney Fahy moved to dismiss the charges at arraignment citing Commonwealth v. DiBennadetto, 436 Mass 310 (2002) while arguing that the report fatally ommitted the necessary elements to support the charge against the Defendant. Case Dismissed at Arraignment.
12/4/23: Rape
The Defendant was indicted on Rape out of Plymouth County based on allegations consistent with a "date rape" scenario. After a week long trial which included testimony from the alleged victim and several witnesses present before/after the alleged events and Chemists from the Massachusetts State Police Lab, the Defendant was found NOT GUILTY
1/16/24: Larceny of a Motor Vehicle; Larceny Over $1,200; Conspiracy
The Defendant was charged with the theft of a commercial motor vehicle out of Norfolk County. Attorney Fahy filed a Motion to Dismiss the charges based on a lack of probable cause to arrest pursuant to Commonwealth v. DiBennadetto, 436 Mass 310 (2002). After arguments, the Judge DISMISSED all charges brought against the Defendant.
10/13/23: Assault & Battery on a Family Member/Household Member
The Defendant was charged with an assault and battery of his then girlfriend. After trial, the Defendant was found Not Guilty of the charge.
11/6/23: Assault with a Dangerous Weapon (Metal Pipe)
The Defendant was charged with the assault of a neighbor in the Taunton District Court. The Defendant was also facing a Superior Court Probation Violation based on these charges. After trial, the Defendant was found Not Guilty.
